Public Private Partnerships (PPPs)

The firm is a leading player in the public private partnership field in Greece. The scope of our work involves the provision of the following services:

• review of legislation applicable to the Contracting Authorities for the preparation of tender documents and implementation of the project through a partnership scheme,
• drafting of the legal section of the draft tender documents,
• preparation of Market Soundings,
• preparation of draft PPP contract documents and review of construction and design consultants and other ancillary contracts,
• drafting and review of risk matrix for PPP projects,
• review of tender documents subject to the applicable Greek and EU legislation currently in force,
• examination and comments regarding the legal aspects of the proposed projects implementation structure,
• consultation services with respect to proposed evaluation criteria,
• supporting the Contracting Authority throughout the tender period, review of financial and security agreements, financing to the SPV and execution of the relevant loan agreement with the object to safeguard the interests of the contracting authority,
• provision of legal support with respect to permits, expropriations and environmental concerns and particularly land use matters in the context of the partnership contracts,
• provision of advisory services and support during all procedures that are required under Greek and Community law for the drafting and signing of the final contract and the loan agreement.
• Review of corporate documentation of SPVs.

The firm has been retained for the following projects:

• Legal advisors to the Hellenic Ministry of Economy and Finance’s PPP Task Force with respect to the project “Construction and Maintenance of Government Housing for the Prefecture of Corinth and Trikala by way of PPP”.
• Legal advisors to the Hellenic Ministry of Development, Competition, Infrastructure, Transportation & Networks PPP Task Force with respect to the project of implementation, through PPP, of a new infrastructure for an Integrated Waste Management System in the region of Western Macedonia.
